With the explicit exception of the exclusions below (paragraph 11), no portion of this web site may be reproduced in any form, or by any means, without prior written permission from Munisiacs. In this document, the terms “Munisiacs” and “web site” refer to any material published on the following domains owned by Munisiacs: Munisiacs.com, Munisiacs.co.uk, MicNight.co.uk and any other future branded domains.
The following rules and regulations (“Terms”) apply to all visitors to or Members of this web site (collectively, “Users”). By accessing this web site, the User acknowledges acceptance of these Terms. Munisiacs reserves the right to change these Terms from time to time at its sole discretion. In the case of any violation of these rules and regulations, Munisiacs reserves the right to seek all remedies available by law and in equity for such violations. These Terms apply to all visits to (all) the Munisiacs web sites, both now and in the future. The term “User” refers to the person responsible for viewing the content or initiating its transmission from any of the above-named domains.
Personal Information received by Munisiacs will be kept in a secure manner and processed in accordance with the laws relating to data protection. Except as expressly provided, any non-personal information or material sent to Munisiacs whether by email or a web-browser form, will be deemed NOT to be confidential. By sending Munisiacs any non-personal information or material, you grant Munisiacs an unrestricted, irrevocable license to use, reproduce, display, perform, modify, transmit and distribute those materials or information, and you also agree that Munisiacs is free to use any ideas, concepts, know-how or techniques that you send us for any purpose. We shall keep information that allows us to contact you (“Personal Information”) confidential. We may from time to time use your Personal Information to contact you about new features and services. We will never give your details to any third party, unless we have expressly stated in additional Terms and Conditions that your details may be shared (e.g. Competition entries).
The only information we may publish about you is your first name (or username), which you give us when you join Munisiacs as a Member. This name may be shown in any page that you edit, such as a venue or band page, to indicate that you are a contributor to the page. You may, however, hide your first name by setting your preferences by logging in and editing “my details”. We will never publish your last name, or any other personal details that you give us when you join.
We may track the number of visitors to this web site. This can include using a “cookie” which would be stored on your computer. Cookies are small files which are used by us to uniquely identify your computer (not you personally), and to enhance your experience of this site. We will take all reasonable care in keeping your Personal Information safe. Your Personal Information will never be disclosed, sold, given or hired to any third party.
5. Your email address
When you join Munisiacs you use an email address to identify yourself. We reserve the right to disallow any email address that we perceive to be misleading or that is being used to “pass off” your identity as being affiliated to, or connected with, Munisiacs. We also reserve the right to change our policy at any time, and delete your Munisiacs account without notice to you if we believe that your email address falls into this category.
6. Sending You email
We may send you email confirmations of gigs that you add to Munisiacs. We may also send you email alerts for any gigs added for your band/artist by a venue, or for any gigs added for your venue by a band/artist. You can turn off these confirmations and alerts in your “my settings” section, or by following the links in our emails.
We may send you email newsletters (usually once a month) to keep you up-to-date with new features on Munisiacs. You may opt-out of these newsletters at any time.
We may also email you a list of gigs in your area every week, if there are any. You may also opt-out of these gig listings. (These gigs are in addition to any specific gig alerts that you have set up. You must manage your specific gig alerts in your “my favourites” section.)
To control your opt-in/opt-out settings, you must either:
• login and edit your “my details” section, or
• respond to our email messages by clicking the “unsubscribe” button or link
You must either confirm your email address to us, or login to Munisiacs, for us to send you newsletters or area-based gig listings. You can do either of these by following the links in our initial welcome email.
7. Content Created By Members
The views expressed in directly posted information from Members of the Munisiacs site are those of the individual Member and not those of Munisiacs or its ISPs.
i. Members are asked not to contribute information which is abusive, racist, obscene, defamatory or the content of which is otherwise undesirable, illegal or in breach of any person’s rights. Munisiacs reserves the right, at its sole discretion, to remove any such information at any time and without notice to any Member. Bona fide requests to remove defamatory content will be honoured, although we can give no guarantee to the time scale.
ii. As this is a family-orientated site, Munisiacs will, at its sole discretion, remove any bad language or explicit adult-orientated words or pictures in posted material, and may terminate your account without notice to you. This also applies to MP3 song titles containing explicit words, and MP3 tracks posted that contain explicit lyrics that have not been marked as such.
iii. Members may not post material that has been designed to distort search engine page rankings. In particular, Members may not employ word repetition techniques, or excessive use of superlatives (such as “A1”, “AAA”, “1st”, “best”, etc). Such material may be removed by Munisiacs without notice to the Member. In such cases, membership may be cancelled without notice to any Member, at the sole discretion of Munisiacs.
iv. Members may not post material that distorts any page, including, but not limited to: width of the page, width of column sections, width of table columns. Such material may be removed by Munisiacs without notice to the Member. In such cases, membership may be cancelled without notice to any Member, at the sole discretion of Munisiacs.
v. Members may not post any gig that is not confirmed, either in writing, by email or verbally, with the other party (band/artist or venue). If the Munisiacs Editors find any evidence of false postings, the Member’s membership will be terminated without notice.
vi. MP3s posted on this site may be subject to copyright restrictions. If you do not own the copyright to songs posted on this site (e.g. “cover” versions or “covers” of existing songs), you MUST select the correct “Licensing category” for the track when you post it onto this site. Failure to correctly identify such tracks, at any time, means that we cannot correctly identify licensed material to the relevant collecting body (such as PRS for Music). In such cases of deliberate mis-categorisation, your MP3s may be removed from this site, and your membership may be terminated by us without notice to you.
vii. Pictures and photos posted on this site may be subject to copyright restrictions. If you do not own the copyright, or have written permission from the copyright holder to such pictures and photos, you must not post them onto this site. If you do post copyrighted pictures or photos without the copyright holder’s permission, we will remove them from this site without notice, and your membership may be terminated by us without notice to you.
viii. Pages created by Members on Munisiacs provide information to the public. If Munisiacs determines that any page should be deleted, amended, or re-assigned to a different Member, it may do so without notice to any Member. In cases of contention, where two or more parties claim “responsibility” for the same page, Munisiacs may attempt to resolve ownership by emailing the parties concerned. If no agreement can be reached, or if no response can be obtained from one or more parties, Munisiacs reserves the right to delete, amend or re-assign pages as it sees fit, and without notice to any Members involved. However, Munisiacs gives no guarantee to any Member that they will be consulted before pages are deleted, amended or re-assigned.
ix. Members are responsible for adding and maintaining correct gig information, including, but not limited to: gig date, gig time, and entrance fee. If any Member persistently posts inaccurate gig information, Munisiacs reserves the right to remove these gigs from the site, and to terminate the Member’s membership without notice.
8. Membership Expiry
When a Member’s membership expires, the Member’s pages and content are no longer editable by the Member, and may be re-assigned by Munisiacs to another Member.
A grace period is normally applied after a membership expires, during which the Member’s pages and content may be protected from deletion or re-assignment. This grace period is currently 21 days, but may be changed, or removed, without notice, at any time by Munisiacs. Munisiacs reserves the right to withdraw the grace period for any Member, for any reason, without notice and without explanation.
In addition to a grace period, Munisiacs operates a holding period of 6 months, during which expired band/artist and venue pages will not have information removed by Munisiacs (although pages may still be adopted by other members and details edited or removed.) The holding period may be changed, or removed, without notice, at any time by Munisiacs.
Following the holding period for bands/artists, the following information will be automatically edited:
• the band/artist MP3s will be removed
• the band/artist YouTube video links will be removed
• the band/artist gallery photos will be removed
• the band/artist diaries will be removed
• the band/artist Facebook link will be removed
The band/artist page itself will be removed from the Member’s account but will remain on the site, and all band/artist gigs will continue to be listed.
Following the holding period for venues, the following information will be automatically edited:
• the venue gallery photos will be removed
• the venue diaries will be removed
• the venue Facebook link will be removed
The venue page itself will be removed from the Member’s account but will remain on the site, and all venue gigs will continue to be listed.
Munisiacs will automatically delete Music Lover accounts where:
• no area gig alerts have been requested and
• no specific band or venue gig alerts have been requested and
• the Member has not logged in for over 12 months
9. Automatic clean-up system
Munisiacs will, on a regular basis, automatically remove band/artist pages and venue pages that hold no useful information. Bands and artists are removed using the following rules:
• no MP3s
• no band/artist description
• no reviews for gigs within the last 18 months
• gigs not updated for at least 12 months
• no gigs within the last 12 months
• band/artist page not updated for at least 12 months
Venues are removed using the following rules:
• no address OR no telephone number (both are required)
• no reviews
• gigs not updated for at least 12 months
• no gigs within the last 12 months
• venue page not updated for at least 12 months
• no functioning website
Full members may re-create these pages again if they wish.
Munisiacs will send notification emails to the page owners when a clean-up is done.
Membership clean-up: Munisiacs will regularly delete Venue, Band/Artist and Music Lover accounts where:
• The most recent login was over 2 years ago and
• The Band/Artist account or Venue account has expired and
• Venue members have no venue pages and Band/Artist members have no band pages and
• We are unable to contact you because our emails to you are being bounced
10. Access to Password Protected/Secure Areas
Access to and use of password protected and/or secure areas of the web site is restricted to authorised Members only. Unauthorised individuals attempting to access these areas of the web site may be subject to prosecution.
Material posted by the Munisiacs Editors and by the registered Members of the Munisiacs site – specifically: sales information, blogs, testimonials and gig reviews – may be quoted and used for non-commercial personal purposes only, without the express permission from Munisiacs, providing that such use is at the sole risk of the person copying and/or distributing such information.
Gig information is available as listings via our gig feed software, and via the share icons on gig pages that connect to Facebook, Twitter and other social media sites. Except for these mechanisms, please do not copy gig information from Munisiacs to other sites or publications without Munisiacs express permission.
The Munisiacs logos shown on the web site may be used freely.
12. Membership Cancellation
You may cancel your Munisiacs membership at any time, by emailing firstname.lastname@example.org
Any subscription fees paid are non-refundable.
13. General Disclaimer
Although Munisiacs has attempted to provide accurate information on this web site, Munisiacs assumes no responsibility for the accuracy of the information. Munisiacs may change the content, and remove any content, at any time, without notice. Mention of, and links to, non-Munisiacs web sites or services is for information purposes only and constitutes neither an endorsement nor a recommendation. Munisiacs is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made on these other sites.
All opinions stated are those of the individual authors and are not the responsibility of Munisiacs. Munisiacs shall not be liable for any indirect, special, consequential, or incidental damages including, without limitation, lost profits or revenues, costs of replacement goods, loss or damage to data arising out of the use or inability to use this site.
To avoid disappointment, we always advise you to check with the venue before setting out to any gig.
14. Applicable Law
These Terms shall be governed by, and construed exclusively in accordance with, English law. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the English courts and, by using this web site, you hereby submit to and waive any objections to the jurisdiction of such courts.
